Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Nano Banana Bingo, including the website at nanobanana.bingo, our AI video generation features, account tools, credit and subscription features, and related services (collectively, the “Service”). In these Terms, “Nano Banana Bingo,” “we,” “us,” and “our” refer to the provider of the Service, and “you” refers to the person or organization using the Service.

1. Acceptance and Eligibility

By accessing or using the Service, creating an account, purchasing credits or a subscription, or submitting content for generation, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

You may use the Service only if you have the legal capacity to enter into a binding agreement and are permitted to do so under applicable law. If you use the Service on behalf of a company, school, agency, or other organization, you represent that you have authority to bind that organization, and “you” includes that organization. You may not use the Service if applicable law, sanctions, export controls, or another legal restriction prohibits your use.

2. Accounts and Google Sign-In

Some features require an account. You may be able to create or access your account using Google sign-in. Your use of Google services remains subject to Google’s applicable terms and privacy practices. You must provide accurate, current information and keep it updated.

You are responsible for safeguarding your account, your Google account, and any device or credentials used to access the Service. You are also responsible for activity occurring through your account unless caused by our failure to use reasonable security measures. Do not share access, allow unauthorized use, or attempt to obtain another person’s account. Notify us promptly at contact@nanobanana.bingo if you believe your account has been compromised or used without authorization.

3. AI Video Generation Service

The Service allows you to submit text prompts and, where supported, images, video, audio, or other media as references or source material (collectively, “Inputs”) and to receive AI-generated videos, images, previews, or related results (“Outputs”). Available models, generation modes, durations, resolutions, reference limits, processing times, and credit costs may vary by feature, plan, model provider, demand, and technical availability.

You are responsible for reviewing your generation settings before submitting a request and for downloading or backing up Outputs you wish to keep. Generation may be queued, delayed, rejected, or unsuccessful. A preview, estimated processing time, or generation status is not a guarantee that an Output will be completed or available at a particular time.

4. Your Inputs and Content Rights

As between you and Nano Banana Bingo, you retain the rights you already hold in your Inputs. These Terms do not transfer ownership of your Inputs to us. You represent and warrant that you own your Inputs or have all permissions, licenses, consents, and other rights necessary to submit them and to authorize their processing under these Terms.

This responsibility includes obtaining any required permission relating to copyright, trademarks, privacy, publicity, likeness, voice, confidential information, personal data, and people depicted or heard in your Inputs. You must not submit material that you are prohibited from sharing or processing, including content subject to confidentiality duties or restrictions imposed by an employer, client, platform, or other third party.

You grant us a non-exclusive, worldwide, royalty-free license to host, copy, transmit, cache, format, reproduce, and process your Inputs only as reasonably necessary to provide the requested generation, display and deliver results to you, operate and secure the Service, troubleshoot failures, enforce these Terms, and comply with law. This license lasts for as long as reasonably necessary for those purposes, including any limited backup, security, dispute, or legal retention period described in our Privacy Policy or required by law.

5. Generated Outputs

As between you and Nano Banana Bingo, and to the extent permitted by applicable law, we do not claim ownership of Outputs generated for you. The legal status of AI-generated material can differ by jurisdiction, and Outputs may not qualify for copyright or other exclusive rights. You are responsible for determining whether and how an Output may be used, registered, licensed, published, or commercialized.

AI systems are probabilistic. Outputs may be inaccurate, incomplete, offensive, unexpected, or unsuitable for your purpose. They may include visual or factual artifacts and may not faithfully reproduce an Input or prompt. You must review Outputs before relying on, publishing, or distributing them, and you remain responsible for your use of every Output.

Outputs are not guaranteed to be unique. Other users may receive the same or similar results, and an Output may resemble existing people, characters, brands, works, places, or media by coincidence or because of the behavior of an underlying model. We do not represent that an Output is non-infringing, accurate, original, exclusive, or cleared for any particular use. You must conduct any review, clearance, disclosure, labeling, or consent process appropriate for your intended use.

6. Prohibited Content and Conduct

You may not use the Service to create, upload, request, or distribute:

  • content or activity that violates applicable law or another person’s intellectual property, privacy, publicity, contractual, or other rights;
  • child sexual abuse material, sexual exploitation of minors, grooming, or any sexualized depiction of a minor;
  • non-consensual intimate imagery, sexual content created from a real person’s likeness without authorization, or content used to harass, stalk, threaten, exploit, or abuse another person;
  • fraudulent or materially deceptive impersonation, including a manipulated depiction of a real person used without necessary consent or disclosure to mislead others;
  • content that promotes terrorism, violent extremism, unlawful discrimination, or credible threats of violence, or that meaningfully facilitates serious wrongdoing or self-harm;
  • malicious code, phishing, credential theft, spam, scams, or material designed to compromise systems, accounts, or personal information; or
  • content that is otherwise prohibited by safety rules or model-provider restrictions presented through the Service.

You also may not:

  • bypass content filters, rate limits, credit controls, access controls, or other technical or safety measures;
  • probe, scan, disrupt, overload, or interfere with the Service or another user’s access, or introduce malware or harmful code;
  • access the Service through unauthorized automated means, scrape the Service, or reverse engineer any non-public part of it except where applicable law expressly permits that activity; or
  • misrepresent your identity, conceal the source of prohibited content, resell unauthorized access, or use another person’s payment method or account without permission.

7. Content Moderation and Enforcement

To protect users, third parties, and the Service, we and our service providers may analyze Inputs, generation requests, and Outputs using automated moderation systems and, where appropriate, manual review. We may reject a request, block or remove content, limit features, preserve relevant records, or suspend an account when we reasonably believe that content or conduct violates these Terms, a provider policy, or applicable law, or presents a security or safety risk.

Moderation systems are not perfect. Our decision not to block content does not mean that the content is permitted, safe, lawful, or endorsed, and it does not reduce your responsibilities. We may report conduct or preserve and disclose information where required by law or when reasonably necessary to address fraud, abuse, security threats, or imminent harm.

8. Credits

Certain generation features consume credits. The number of credits required may depend on the selected model, duration, resolution, generation mode, reference media, or other settings. Applicable costs and plan details are shown in the Service or at purchase and form part of your agreement with us.

Credits are limited rights to use eligible Service features. They are not money, stored value, a deposit, or legal tender; they have no cash value except where applicable law requires otherwise; and they may not be transferred, sold, or exchanged unless we expressly permit it. Promotional or complimentary credits may be subject to additional terms disclosed when they are issued.

Credit treatment for rejected, failed, canceled, duplicated, or partially completed requests follows the rules displayed in the Service and the policy applicable when the request or purchase was made. We may correct a credit balance when necessary to address billing errors, refunds, chargebacks, fraud, abuse, or technical failures.

9. Subscriptions, Renewal, and Cancellation

Paid plans may be offered as recurring subscriptions. The price, included credits or features, billing frequency, renewal terms, and any plan-specific conditions are presented before purchase. By starting a subscription, you authorize us and our payment processor to charge the payment method you provide for the initial purchase and each renewal, together with applicable taxes and disclosed fees.

Unless the purchase screen states otherwise or applicable law requires a different result, a subscription renews automatically at the end of each billing period until canceled. You may cancel future renewal using available account or billing controls or by contacting us. Cancellation generally takes effect at the end of the current paid period and does not itself create a right to a refund for that period. You should cancel before the renewal is processed if you do not want the next billing period.

We may change plans, credit allocations, or prices for future billing periods. When required, we will provide notice and an opportunity to cancel before a material change takes effect. Continued use of a paid subscription after the effective date authorizes billing under the updated terms shown to you.

10. Payments, Taxes, Refunds, and Chargebacks

You must provide accurate billing information and are responsible for keeping your payment method current. Payments may be processed by a third-party payment provider under its own terms. We may suspend paid features, retry a charge, or cancel an order or subscription if payment is declined, reversed, unauthorized, fraudulent, or otherwise not completed.

Prices may exclude taxes unless stated otherwise. You are responsible for taxes, duties, levies, or similar governmental charges associated with your purchase, except taxes imposed on our income. Where required, we or our payment provider may calculate, collect, and remit applicable taxes.

Cancellations, refunds, and restoration of credits are governed by applicable law and the refund or purchase policy displayed when you buy the relevant credits or subscription. Except where required by law or expressly stated in that policy, completed purchases are final. Before initiating a chargeback, please contact us so we can investigate a billing issue. We may restrict an account while a payment dispute or suspected payment abuse is under review.

11. Third-Party Services and AI Models

The Service depends on third parties, which may include Google sign-in, payment processors, cloud hosting and storage providers, content moderation providers, analytics services, and AI model or API providers. These third parties may process information or impose their own terms, acceptable-use rules, technical limits, and privacy practices. You must comply with third-party restrictions that are disclosed to you or apply to a feature you choose to use.

We do not control third-party services or models and are not responsible for their independent acts, omissions, availability, policy changes, or outputs. A reference or link to a third-party product does not imply sponsorship or endorsement. Model names and third-party trademarks belong to their respective owners.

12. Nano Banana Bingo Intellectual Property

The Service, including its software, interface, design, documentation, branding, and original site content, is owned by or licensed to Nano Banana Bingo and is protected by applicable intellectual property laws. This section does not apply to your Inputs, your rights in Outputs, or third-party materials.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose. No other right or license is granted. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative services from protected parts of the Service except with our written permission or as expressly allowed by applicable law.

13. Feedback

If you provide ideas, suggestions, evaluations, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, adapt, disclose, and commercialize that feedback without restriction or compensation. Do not submit feedback you consider confidential or that you are not authorized to provide. This section does not transfer ownership of your Inputs or Outputs.

14. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with the Service. By using the Service, you acknowledge that processing. If you submit personal information about someone else, you are responsible for having a lawful basis and providing any required notices or obtaining any required consent.

15. Service Changes and Availability

We may add, modify, limit, suspend, or discontinue features, models, plans, integrations, or portions of the Service to address technical, commercial, legal, security, or provider requirements. We will use reasonable efforts to give notice of changes that materially reduce a paid feature when notice is practical and required by law.

The Service may experience interruptions, queues, maintenance, data loss, model changes, or errors. We do not guarantee continuous or uninterrupted availability, a particular model or feature, permanent storage of Inputs or Outputs, or compatibility with every device, browser, format, or workflow. You should maintain independent copies of important Inputs and Outputs.

16. Suspension and Termination

You may stop using the Service at any time and may cancel a subscription as described above. You may request account assistance by contacting us. Subject to applicable law, we may restrict, suspend, or terminate access if you materially or repeatedly violate these Terms, fail to pay amounts due, create legal or security risk, abuse the Service, or if a third-party dependency or legal requirement makes continued access impracticable.

Where appropriate, we may provide notice and an opportunity to cure a violation, but we may act immediately when reasonably necessary to prevent harm, fraud, unauthorized access, or legal exposure. Following termination, your right to use the Service ends. Treatment of remaining credits, current subscriptions, and refunds remains subject to applicable law and the policies presented at purchase.

Provisions that by their nature should survive termination will survive, including provisions concerning ownership, licenses already necessary to complete processing or legal retention, payment obligations, disclaimers, liability limitations, indemnification, and dispute terms.

17. Disclaimers

To the maximum extent permitted by applicable law, the Service and all Outputs are provided “as is” and “as available.” Nano Banana Bingo and its service providers disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that the Service will meet your requirements, that generation will succeed, that credits will always produce a usable Output, or that Outputs will be lawful or suitable for your intended use. Outputs are not professional, legal, medical, financial, safety, or other expert advice. You are responsible for independent review and for taking appropriate precautions before relying on an Output.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted, and you retain any non-waivable rights.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Nano Banana Bingo and its affiliates, personnel, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, opportunities, data, Inputs, or Outputs, arising from or related to the Service, even if advised that such harm was possible.

To the maximum extent permitted by law, our aggregate liability arising from or relating to the Service or these Terms will not exceed the greater of the fees you paid for the relevant Service during the billing period in which the event giving rise to the claim occurred or the minimum amount of liability that applicable law does not permit us to exclude.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law makes such liability non-waivable. These limitations are an essential basis of the agreement between you and us.

19. Indemnification

To the extent permitted by applicable law, you will defend, indemnify, and hold harmless Nano Banana Bingo and its affiliates, personnel, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from your Inputs, Outputs as used or distributed by you, your violation of these Terms or applicable law, or your infringement or misuse of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

We will provide reasonable notice of a covered claim and may control its defense and settlement. You will reasonably cooperate, and we will not agree to a settlement that imposes a personal admission or non-monetary obligation on you without your consent. Mandatory consumer protections remain unaffected.

20. Applicable Law and Disputes

These Terms are governed by applicable law, without depriving you of mandatory consumer protections that apply in your place of residence. Any court, tribunal, or authority with lawful jurisdiction may hear a dispute. Before starting formal proceedings, you and Nano Banana Bingo are encouraged to attempt to resolve the issue in good faith by contacting the other party, unless immediate relief is reasonably necessary or the law provides another procedure.

21. Changes to These Terms

We may update these Terms to reflect changes to the Service, providers, law, safety practices, or business operations. The updated Terms will be posted on this page with a revised “Last updated” date. When required by law, we will provide additional notice of material changes. Changes apply prospectively from their effective date.

If you continue using the Service after updated Terms take effect, you agree to the updated Terms. If you do not agree, you must stop using the Service and cancel any future subscription renewal before it is charged.

22. General Terms

These Terms, the Privacy Policy, and any plan, purchase, promotion, or feature-specific terms presented to you form the agreement governing the Service. If feature-specific terms conflict with these Terms, the more specific terms control for that feature or transaction.

If a provision is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. Section titles are for convenience only. You may not transfer your account or assign your rights or obligations under these Terms without our consent, except where applicable law permits otherwise.
